The reform of the National Labour Inspectorate will come into force in just a few weeks. Once the new regulations are in place, inspectors will be checking, amongst other things, the issue of working hours.
During inspections, they will not focus solely on the number of hours indicated in documents. The key factors will be how working time is organised and whether there is, in reality, the subordination characteristic of an employment relationship. As she emphasises, the line is drawn between the contractor’s actual autonomy and mere apparent autonomy – that is, between a situation where a person actually decides when and how they work, and one where this freedom exists only in name.
