The bankruptcy proceedings of Getin Noble Bank have once again attracted public attention. The case has sparked a debate on the limits of oversight over the practice of restructuring advisors. Prawo.pl asked Justyna Burska to comment on the matter.
Our expert pointed out that, under the applicable regulations, the Minister of Justice may not interfere with the substantive assessment of actions taken by a restructuring advisor in a specific proceeding if those actions have been approved by the judge-commissioner or the court. However, as Justyna Burska emphasizes, the legislator has also provided for exceptions to this rule. In certain circumstances, supervisory measures may be undertaken.
