In the article in Rzeczpospolita, “Shutting your eyes won’t help: the Decree will not disappear.” Tomasz Ludwik Krawczyk, Ph. D. disputes with the prosecutor Jacek Wygoda on the validity of the so-called Warsaw Decree. Mr Wygoda claims in the article “Bierut Decree is no longer in force” inter alia that the Decree lost its power “on 30 December 2001 at the latest ” and, in result, all administrative decisions issued on its basis are vitiated by nullity.
Adv. T. Krawczyk argues with prosecutor Jacek Wygoda:
“Before demonstrating the inaccuracy of the arguments used in the article, it is worth noting that the author points out several possible causes and several competing dates of the alleged derogation of the Decree. Considering that validity of legal acts is zero-one system, the uncertainty as to the cause and expiry date of the Decree is an indicative of the weakness of the argumentation used.”
